Introduction
FUTURE TECHNOLOGIES FOR MEDICAL SERVICES ("we," "us," or "our"), located at Ar Rass Al Qassim 58872, Building No.6433, is the provider of the FTMS Care mobile app ("App"). We are committed to protecting your privacy and complying with the Health Insurance Portability and Accountability Act (HIPAA) where applicable. This Privacy Policy explains how we collect, use, share, and protect your Personal Information and Protected Health Information (PHI) when you use the App or website (ftms.live/live-sessions/pharmacies/6796cc4b55cf5/login?live_session_type_id=3) to register, provide basic information (name, birth date, gender, allergies, pregnancy status, symptoms), engage in secure video consultations with licensed doctors (registered via our management dashboard), and receive prescriptions. Doctors use a separate app and are covered by a distinct policy.
By using the App, you consent to this policy and our HIPAA-compliant Notice of Privacy Practices.
1. Types of Information We Collect
- Personal Information: Name, email, phone number, birth date, gender, address (from registration via App or website), device ID, IP address, and usage data (e.g., call logs).
- Protected Health Information (PHI): Symptoms, allergies, pregnancy status, medical history, diagnoses, prescriptions, and audio/video recordings of consultations (if enabled with explicit consent). All PHI is encrypted and stored securely.
- Automatically Collected: App interactions, crash reports, and browser integration data for calls. We do not collect unnecessary location data unless required for call quality.
2. How We Collect Information
- Directly from You: Through registration (App or website), input forms (e.g., symptoms), or during video consultations.
- Automatically: Via cookies, logs, and analytics tools (e.g., Firebase for crash reporting, configured to anonymize data where possible).
- From Third Parties: Verification services for doctor credentials (e.g., via dashboard integrations).
3. How We Use Your Information
We use your information in compliance with HIPAA’s minimum necessary standard:
- Provide Services: Facilitate video consultations, deliver prescriptions to you or pharmacies (e.g., Zahrat Al Rawda), and manage your profile.
- Improve the App: Analyze usage for bug fixes and enhancements (anonymized where possible).
- Communications: Send appointment reminders, service updates, or HIPAA-required notices.
- Legal/Compliance: Detect fraud, respond to legal requests, or meet HIPAA and other privacy laws.
- With Consent: For marketing or research purposes (you may opt out at any time).
4. How We Share Your Information
We do not sell your data. Sharing occurs only as permitted by HIPAA and with your consent:
- Service Providers: HIPAA-compliant providers (e.g., AWS with a Business Associate Agreement, Twilio for video calls) bound by confidentiality.
- Affiliates/Legal: Within our organization for operations or to comply with legal obligations (e.g., court orders, HIPAA audits).
- Doctors/Pharmacies: PHI shared with doctors during consented consultations; prescriptions sent securely to pharmacies or patients.
- Business Transfers: In mergers or acquisitions, with prior notice and safeguards.
De-identified data may be used for aggregated analytics. No data is shared for advertising purposes.
5. Security and Data Protection
We implement HIPAA-compliant safeguards per the Security Rule, including AES-256 end-to-end encryption for video calls and PHI, secure servers, access controls, and regular security audits. However, no system is 100% secure. Report issues to info@ftms.live. You are responsible for using strong passwords and enabling two-factor authentication.
6. Data Retention
Personal Information is retained as long as your account is active, plus 7 years post-termination for legal compliance. PHI is retained per medical record laws (e.g., 6-10 years under HIPAA). Data is deleted or anonymized when no longer needed.
7. Your HIPAA and Privacy Rights
- Access/Update/Delete: Request access to your PHI, corrections, or deletion via App settings or info@ftms.live (within 30 days per HIPAA §164.524).
- Accounting of Disclosures: Request a list of PHI disclosures (§164.528).
- Opt-Out: Opt out of marketing communications or cookies via App preferences.
- Privacy Laws: Exercise rights under HIPAA (access/amend PHI), GDPR (EU), or CCPA (California).
We respond to requests within 45 days (extendable). Appeals are available via info@ftms.live.
8. Breach Notification
In case of a PHI breach, we will notify affected users within 60 days per HIPAA (§164.404) and report to authorities if required.
9. Children's Privacy
The App is not intended for users under 18, and we do not knowingly collect data from children.
10. International Data Transfers
Data may be transferred internationally (e.g., to secure servers in the US or EU) with safeguards like HIPAA-compliant Business Associate Agreements and Standard Contractual Clauses.
11. Changes to This Policy
We may update this policy periodically. Changes will be posted on ftms.live or within the App, with prior notice. Continued use constitutes acceptance.
